Notice of Intent – Office of Agricultural and Environmental Sciences – Agricultural Chemistry and Seed Commission

In accordance with the Administrative Procedure Act, R.S. 49:950, et. seq., and pursuant to the authority set forth in La. R.S. 3:1433, notice is hereby given that the Department of Agriculture and Forestry, through the Agricultural Chemistry and Seed Commission, intends to amend LAC 7:XIII.763, which is currently effective as an emergency rule.

The proposed Rule removes the requirement of testing seed cane grown in fields for sugarcane yellow leaf virus. The proposed Rule removes language that the second inspection to be conducted in June by LDAF inspectors will include the collection of leaf samples for the detection of Sugarcane Yellow Leaf Virus. The proposed Rule also removes the language that individual fields shall be sampled by LDAF inspectors for the detection of Sugarcane Yellow Leaf Virus and the sampling requirements. The proposed Rule removes language that tissue samples shall be submitted to the LSU Ag Center Sugarcane Disease Detection Lab for analysis. The proposed Rule removes language that LDAF shall have the right to re-inspect, re-sample, and re-test fields that are out of tolerance for Sugarcane Yellow Leaf Virus prior to certification. The proposed Rule clarifies Field Standards by removing Sugarcane Yellow Leaf Virus standards, along with removing the factor determined by lab analysis for the LSU Sugarcane Disease Detection Lab.
