Notice of Intent Filed with State Register LAC 7:XXVII.103,141 Agricultural Commodities Commission
Number of Commission Meetings/Excessive Deduction Defined
September 10, 2019
LDAF has filed a notice of intent with the State Register giving public notice that the Louisiana Department of Agriculture and Forestry, pursuant to the authority in La. R.S. 3:3403, 3405, 3414.3, and 3419, intends to amend LAC 7:XXVII.103 and 141 relative to the Agricultural Commodities Commission. The proposed rule changes modify Agricultural Commodities Commission rules that are already in place. The proposed action will amend LAC 7:XXVII.103 to eliminate the regulatory requirement that the Louisiana Agricultural Commodities Commission meet at least once per quarter as R.S. 3:3403 was recently amended to require that the commission meet three times per calendar year, but may meet more frequently upon the call of the chairman. The proposed rule change simply eliminates language that is inconsistent with current law. The proposed change to §141 clarifies language regarding one category of records that licensees must maintain, modifying it from excessive damage of 7.5% to language that more closely tracks the federal guidelines set forth in the U.S. Department of Agriculture’s Grain Inspection Handbook.
Written submissions must be directed to Kyra Fitzgerald, Louisiana Agricultural Finance Authority, Department of Agriculture and Forestry, 5825 Florida Blvd, Baton Rouge, LA 70806 and must be received by no later than 12 p.m. on October 20, 2019. No preamble is available regarding the proposed regulations.
