Notice of Intent filed with State Register (LAC 7:XXIII.711) – Certification of Commercial Applicators

LDAF has filed a notice of intent with the State Register giving public notice that the Louisiana Department of Agriculture and Forestry, pursuant to the authority set forth in R.S. 3:3203, intends to amend LAC 7:XIII.711 to require that to maintain their certification, all certified pesticide applicators, as opposed to the previous requirement of only commercial aerial applicators, must attend an off-target training course if the certified pesticide applicator has been found to be in violation of the Louisiana Pesticide Law or rules and regulations pertaining to drift, or has received a “warning letter” from the Department pertaining to drift prior to making an application in the following calendar year. Additionally, clarifying language is added to LAC 7:XXIII.711 to specify that the violations must be related to drift.

Interested persons may submit written comments, data, opinions, and arguments regarding the proposed Rule. Written submissions must be directed to Kevin Wofford, Director of the Advisory Commission on Pesticides, Department of Agriculture & Forestry, 5825 Florida Blvd., Baton Rouge, LA 70806 and must be received no later than 4:00 p.m. on the 10th day of October, 2019.
